1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Bitcoin Apex ("we," "us," or "our") regarding your use of the Bitcoin Apex platform and related services (collectively, the "Service").

By creating an account, accessing the platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Disclaimer.

2. Eligibility Requirements

To use Bitcoin Apex, you must meet the following eligibility criteria:

• Age Requirement: You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.
• Legal Capacity: You must have the legal capacity to enter into binding contracts.
• Jurisdiction: You must be accessing our Service from a jurisdiction where cryptocurrency trading is legal and not prohibited.
• Account Restrictions: You have not been previously suspended or removed from the platform.
• Identity Verification: You must successfully complete our identity verification (KYC) process.
• Financial Capacity: You acknowledge that you can afford potential losses from trading activities.

We reserve the right to verify your eligibility at any time and may request additional documentation to confirm compliance with these requirements.

3. Account Registration and Security

3.1 Account Creation

To access our trading services, you must create an account by providing accurate, current, and complete information. You agree to:

• Provide truthful and accurate information during registration
• Maintain and promptly update your account information
• Complete the required identity verification process
• Maintain only one account (duplicate accounts are prohibited)

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Create a strong, unique password and keep it confidential
• Enable two-factor authentication (2FA) when available
• Immediately notify us of any unauthorized access or security breach
• Not share your account credentials with any third party
• Log out from your account at the end of each session on shared devices

Bitcoin Apex is not liable for any losses resulting from unauthorized use of your account if you fail to maintain adequate security measures.

3.3 Account Termination

Either party may terminate your account at any time:

• Your Right to Terminate: You may close your account at any time by withdrawing all funds and contacting support.
• Our Right to Terminate: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any reason at our sole discretion.

4. Trading Services and Platform Use

4.1 Nature of Services

Bitcoin Apex provides an automated cryptocurrency trading platform that connects users with licensed broker-dealers. We facilitate trading but do not act as a broker, exchange, or custodian of funds.

4.2 Automated Trading

Our platform offers automated trading features powered by algorithmic systems. You acknowledge and agree that:

• Automated trading involves risks and no guarantee of profits exists
• You maintain full control and can disable automation at any time
• You are responsible for monitoring your account and trading activities
• System performance may be affected by market conditions, connectivity issues, or technical failures
• Past performance is not indicative of future results

4.3 Trading Risks

You acknowledge that cryptocurrency trading carries substantial risk, including but not limited to:

• High market volatility leading to rapid price fluctuations
• Possibility of losing your entire investment
• Liquidity risks in certain markets
• Regulatory changes affecting market conditions
• Technology failures or security breaches

You agree to only invest funds you can afford to lose and accept full responsibility for your trading decisions.

5. Deposits, Withdrawals, and Fees

5.1 Deposits

The minimum deposit to activate trading features is $250 AUD. Deposits are processed through our partnered payment processors and credited to your broker account, not held directly by Bitcoin Apex.

5.2 Withdrawals

You may request withdrawal of your funds at any time, subject to:

• Successful identity verification
• Completion of any open trading positions
• Compliance with anti-money laundering requirements
• Processing times varying by payment method (typically 1-5 business days)

5.3 Fees and Charges

Bitcoin Apex does not charge platform fees for account creation or maintenance. However:

• Our broker partners may charge trading commissions and spreads
• Payment processors may charge transaction fees for deposits/withdrawals
• Your bank may charge fees for international transactions
• All fees are disclosed before transactions are processed

6. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Fraudulent Activity: Engaging in fraud, market manipulation, or deceptive practices
• Illegal Transactions: Using the platform for money laundering, terrorist financing, or other illegal purposes
• Unauthorized Access: Attempting to access other users' accounts or platform systems without authorization
• System Interference: Disrupting, damaging, or impairing platform functionality
• Bot/Automation Abuse: Using unauthorized bots, scripts, or automated tools to gain unfair advantages
• False Information: Providing false, inaccurate, or misleading information
• Multiple Accounts: Creating multiple accounts to circumvent restrictions or exploit promotions
• Intellectual Property Violation: Infringing on Bitcoin Apex's or third parties' intellectual property rights
• Reverse Engineering: Attempting to decompile, reverse engineer, or extract source code from the platform

Violation of these prohibitions may result in immediate account suspension, termination, and potential legal action.

7. Intellectual Property Rights

All content, features, and functionality of the Bitcoin Apex platform, including but not limited to text, graphics, logos, images, software, and algorithms, are owned by Bitcoin Apex or our licensors and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal trading purposes only. You may not:

• Copy, modify, distribute, or reproduce any platform content
• Use Bitcoin Apex branding, logos, or trademarks without written permission
• Create derivative works based on the platform
• Commercially exploit any platform content or features

8. Third-Party Services and Links

Bitcoin Apex integrates with third-party services including broker platforms, payment processors, and identity verification providers. We are not responsible for:

• The availability, accuracy, or reliability of third-party services
• Content, policies, or practices of third-party websites linked from our platform
• Transactions or interactions between you and third-party service providers
• Any losses or damages arising from third-party services

Your use of third-party services is governed by their respective terms and conditions.

9. Disclaimer of Warranties

The Bitcoin Apex platform and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of platform content
• Uninterrupted, secure, or error-free operation
• Specific trading results or profitability
• Freedom from viruses or harmful components

We do not warrant that the platform will meet your requirements or that defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Bitcoin Apex and its affiliates, officers, directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:

• Your use or inability to use the platform
• Trading losses or investment decisions
• Unauthorized access to your account
• Platform errors, interruptions, or security breaches
• Third-party actions or omissions
• Any other matter relating to the Service

Our total liability to you for all claims shall not exceed the amount of fees paid by you to Bitcoin Apex (if any) during the twelve months preceding the claim.

Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bitcoin Apex, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your use or misuse of the platform
• Your trading activities and decisions
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through the following process:

1. Informal Resolution: Contact our support team to attempt resolution
2. Mediation: If informal resolution fails, disputes may be submitted to mediation
3. Arbitration: Unresolved disputes shall be submitted to binding arbitration in accordance with Australian arbitration rules

12.3 Class Action Waiver

You agree that disputes will be resolved individually and waive any right to participate in class actions or representative proceedings.

13. Modifications to Terms

Bitcoin Apex reserves the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date
• Notify you via email or prominent platform notice
• Provide a reasonable opportunity to review changes

Your continued use of the platform after changes become effective constitutes acceptance of the modified Terms. If you do not agree with changes, you must discontinue use of the Service.

14. Force Majeure

Bitcoin Apex shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, internet failures, or other force majeure events.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Bitcoin Apex regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
